The High Court of the Federal Capital Territory has nullified the All Progressives Grand Alliance’s (APGA) primary election in Anambta south.
The primary was conducted in October and Nicholas Ukachukwu was adjudged winner and expected to fly the party’s flag at the senatorial election in 2019.
The Punch reports that the court on Thursday, December 13 nullified the election following a suit filed by an aggrieved aspirant for the same position, Dr Okey Chidolue
Justice Valentine Ashi agreed with the plaintiff that the primary was marred by irregularities and was conducted in disregard to the relevant provisions of the Nigerian Constitution, the Electoral Act and the party’s electoral guidelines.
The judge nullified the primary election as well as the ticket issued to Ukachukwu.
Nullifying the primary, the judge faulted the party’s claim that Ukachukwu was elected through an electoral college that comprised three delegates from each of the wards in the senatorial district.
Justice Ashi noted that the party failed to produce the names of the delegates that participated in the exercise which was also corroborated by the Independent National Electoral Commission which said its officials were not provided with the list of delegates.
He said: “The question to be asked here is this; if the defendants were certain that they were using the legitimate list of delegates, why did they have to hide it from INEC officials?
“In totality, the defendants’ case is so weak that it has only helped to strengthen the plaintiff’s case.”
Meanwhile, about 3,250 members of All Progressives Congress (APC) and Peoples Democratic Party (PDP) in Obi Local Government Area (LGA) of Nasarawa state
According to Nigerian Tribune, the governorship candidate of the party, Labaran Maku received the defectors in Obi LGA on Thursday, December 13, during his campaign visit.
Speaking at the event, leaders of the defectors, Ubul Ukor and Elias Manasseh cited the failure of their former parties to address the security challenges in the state as the reason for their decision.
